Terms of Service

1. Acceptance of Terms

By accessing or using Tempo Socials ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Tempo Socials.

2. Description of Service

Tempo Socials provides an Instagram growth service that helps users gain real, niche-targeted followers through automated engagement. The Service operates by logging into your Instagram account and performing follow and unfollow actions on your behalf, at rates designed to stay within safe thresholds. All automation runs through residential proxies to protect your account's appearance of organic activity.

3. Account Registration

• You must be at least 18 years old to use the Service
• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized use of your account
• One person or entity may not maintain more than one account without prior written approval

4. Instagram Account Access

To use the Service, you must connect your Instagram account by providing your Instagram login credentials. By doing so, you:

• Authorize us to log into your Instagram account and perform follow and unfollow actions on your behalf
• Confirm that you are the rightful owner of the Instagram account and have the right to authorize such access
• Acknowledge that Instagram's own Terms of Service apply to your account and that automated engagement may conflict with them
• Understand that we do not store your Instagram password — we store only the session state generated after login

5. Instagram Account Risk

Using any third-party automation service, including Tempo Socials, carries inherent risk to your Instagram account. By using the Service, you expressly acknowledge and accept that:

• Instagram may restrict, temporarily block, or permanently ban your account for use of automation, regardless of the rate or method
• Tempo Socials takes precautions (conservative limits, residential proxies, human-like patterns) to reduce this risk, but cannot eliminate it
• We are not liable for any Instagram account action including temporary blocks, action blocks, reduced reach, or permanent bans
• You use the Service entirely at your own risk with respect to your Instagram account

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable local, provincial, national, or international law or regulation
• Harass, abuse, spam, or harm other Instagram users
• Promote hate speech, illegal content, or content that violates Instagram's Community Guidelines
• Run the Service simultaneously with other Instagram automation tools on the same account
• Attempt to reverse engineer, decompile, or disassemble any part of the Service
• Share your account credentials with third parties
• Resell or sublicense access to the Service without our written consent

We reserve the right to suspend or terminate accounts that violate these policies without refund.

7. Service Limitations

• Growth results vary based on your niche, content quality, posting frequency, and Instagram account history
• We do not guarantee specific follower counts, growth rates, or outcomes
• Followers gained are real Instagram users who choose to follow you — we do not use fake accounts or bots
• We reserve the right to adjust engagement rates at any time to maintain account safety
• The Service may be temporarily unavailable due to maintenance, infrastructure issues, or Instagram platform changes

8. Payment and Billing

• Subscription fees are billed in advance on a monthly basis via Stripe
• All prices are in USD unless otherwise stated
• We reserve the right to change pricing with 30 days' notice via email
• Failure to pay may result in suspension or termination of your account
• Payments are processed securely by Stripe — we do not store your payment card information

9. 30-Day Money-Back Guarantee

We offer a 30-day money-back guarantee on your first subscription payment, subject to the following conditions:

• The guarantee applies to your first month of service only — it does not apply to renewals
• You must request a refund within 30 days of your initial payment by contacting [email protected]
• The guarantee does not apply if your account was suspended or terminated for violation of these Terms
• The guarantee does not apply if your Instagram account was banned or restricted — account risk is accepted by the user under Section 5
• Refunds are processed within 5–10 business days via the original payment method

10. Cancellation

You may cancel your subscription at any time from your account settings or by contacting support. Upon cancellation, your service will continue until the end of the current billing period. No partial refunds are issued for unused time in the current period (except as covered by the 30-day guarantee above). After cancellation, automated growth activity will stop and your account data will be retained for 30 days before deletion.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Tempo Socials and its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or Instagram account standing, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total aggregate liability to you for any claims arising under these Terms shall not exceed the amount you paid us in the 30 days preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Tempo Socials and its owners, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights including Instagram's Terms of Service.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes your acceptance of the modified Terms.

15. Termination

We may suspend or terminate your account at any time for violation of these Terms, non-payment, or at our sole discretion with reasonable notice. Upon termination, your right to use the Service ceases immediately. Sections 5, 11, 12, 13, and 16 survive termination.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
